The right of permanent residence of a family member of an EU citizen

A family member of an European Union (EU) citizen, who has resided in Estonia permanently for five successive years on the basis of the right of temporary residence, has a right to apply for registration of the right of permanent residence. As an exception you can register the right of permanent residence prior fulfilment of 5 years.

A minor child younger than 1 year, of a family member of EU citizen who resides in Estonia on the basis of the right of permanent residence, is also entitled to the right of permanent residence.

For registration of the right of permanent residence please address in person a Service Office. In case if less than 2 years have passed from the previous applying for an identity document, residence permit or right of residence and from capturing of fingerprints, you can also apply for registration of the right of permanent residence by post (it is not possible to apply by post on behalf of a child younger than 1 year). An application on behalf of a minor child under age 15 is submitted by his/her legal representative (e.g. parent, guardian).

Documents requested for registration


If you apply for registration of the right of permanent residence on behalf of a minor child under age 15, the following must be added to the above-mentioned documents:

  • a child’s birth certificate (except if the data of the document have been entered into the population register of Estonia);
  • a child’s identity document, if such exists;
  • a parent’s identity document;
  • if the parent's name in the child's birth certificate differs from the name in the parent's identity document, please submit a document certifying the change of the name of the parent (e.g. certificate of marriage), if the name was changed in a foreign country.
  • If the application is being submitted by a guardian who has been appointed by the court, or by a legal representative of the guardianship authority, then the following must also be added:
    • an identity document of the legal representative;
    • a document certifying the right of representation (except if the data of the document have been entered into the population register of Estonia);
    • an authorization letter (if the application is being submitted by an authorized representative of a guardianship authority).


Decision on registration of or refusal to register the right of permanent residence
The registration of or refusal to register the right of permanent residence shall be decided within 1 month from acceptance of the application for proceeding, but not later than 10 days prior the expiry of the validity term of a right of temporary residence.

In the case of registration of the right of residence the residence card shall be issued to the applicant in person within 30 days at the Service Office named on the application form. The residence card of a minor under age 15 shall be issued to his/her legal representative.
