The right of temporary residence of a family member of an EU citizen

In case if you are a family member of an European Union (EU) citizen, you can apply for the right of temporary residence with an EU citizen:

  • who is working as an employed or self-employed (FIE) person;
  • who has sufficient funds for subsistence of himself/herself and his/her family members and who has medical insurance (Eesti Haigekassa);
  • who studies in Estonia and  who has sufficient funds for subsistence of himself/herself and his/her family members and who has medical insurance (Eesti Haigekassa).


For submission of an application please address in person a Representation of the Republic of Estonia or a Service Office. An application on behalf of a minor child under age 15 is submitted by his/her legal representative (e.g. parent, guardian).

A minor child younger than 1 year, of a family member of an EU citizen who resides in Estonia on the basis of the right of temporary residence, is also entitled to the right of temporary residence.

Documents requested for registration


If you apply for the right of temporary residence on behalf of a minor child under age 15, then the following must be added to the above-mentioned documents:

  • a child’s birth certificate (except if the data of the document have been entered into the population register of Estonia);
  • a child’s identity document, if such exists;
  • a parent’s identity document;
  • if the parent's name in the child's birth certificate differs from the name in the parent's identity document, please submit a document certifying the change of the name of the parent (e.g. certificate of marriage), if the name was changed in a foreign country not in Estonia.
  • If the application is being submitted by a guardian who has been appointed by the court, or by a legal representative of the guardianship authority, then the following must also be added:
  • an identity document of the legal representative;
  • a document certifying the right of representation (except if the data of the document have been entered into the population register of Estonia);
  • an authorization letter (if the application is being submitted by an authorized representative of a guardianship authority).


Decision on granting of or refusal to grant the right of residence
Granting of or refusal to grant the right of temporary residence shall be decided within 3 months from the acceptance of the application for proceeding.

In the case of granting of the right of residence the residence card shall be issued to the applicant in person within 30 days or to the authorised representative appointed by the applicant on the application form upon applying for the document (recommended form, can be filled in on a computer screen or printed out and filled in by hand) to the Service Office or the representation of the Republic of Estonia named on the application form.

Delivery of the ID card to a foreign representation may take more time. For information concerning the arrival and delivery of document please contact the foreign representation of the Republic of Estonia, whereto you have ordered the document. A document of a minor under age 15 shall be issued to his or her legal representative or to an authorised person appointed by the representative.

Extension of the right of temporary residence
Please submit an application for extension of temporary residence permit in person at a Service Office at least one month prior the expiry of the current residence permit. In case if less than 5 years have passed from the previous applying for the right of residence and from capturing of fingerprints, you can also apply for extension of the right of residence by post.

The decision on extension of or refusal to extend the right of temporary residence shall be made at the latest 10 days prior the expiry of the validity term of the right of temporary residence. The residence card shall be issued within 30 days at the Service Office named on the application form.

When receiving the ID-card please present:

  • please provide a previously issued valid document of the same type


An authorised representative:

  • provides his or her valid identity document issued in Estonia
  • provides a valid document of the same type, issued to the applicant, if such document exists
